PRIVACY POLICY Esaya, Inc. ("Esaya") has created this privacy policy ("Privacy Policy") in order to demonstrate our commitment to customer privacy. Privacy on the World Wide Web site located at http://www.gathera.com and other computer systems operated by Esaya (collectively, the “Website”), is of great importance to us. Because we gather important information from our users, we have established this Privacy Policy as a means to communicate our information gathering and dissemination practices. We reserve the right to change this Privacy Policy and will provide notification of the change at least thirty (30) days prior to the change taking effect. Please be aware that the Gathera Internet account aggregation program (“Software”) and Website (collectively “Services”) are not intended for use by persons under the age of 13. Please see the section Children’s Privacy Policy for more details. If you have objections to the Privacy Policy, you should not access or use the Services offered by Esaya. Any capitalized terms used and not defined in the Privacy Policy are defined in the Terms of Service. 1.Collected Information and how we use it If payment is required for the Software, Esaya will request your name, mailing address, phone number, credit card information and other information to securely process the financial transaction. Esaya does not share, rent or lease this information with any third party nor will it use this information for any marketing or promotional use. Esaya uses a third-party intermediary to manage the credit card processing. This intermediary is solely a link in the distribution chain, and is not permitted to store, retain, or use the information provided, except for the sole purpose of credit card processing. Using the Software requires the Esaya servers to host your personal data and information ("Data"). Such Data may include your username and password to your Linked Accounts and your email addresses. Esaya does not scan the messages or information for specific words or phrases and will not read, share, distribute, print, reference or disclose to third parties private email communications or other messages or Data that are transmitted using the Services excepting as required for the purpose of resolving a problem, support issue, or suspected violation of the Terms of Service, or as may be required by law. As part of the Services, you have the option to send a standard message inviting your contacts to join you in using the Services. It will be sent to your contacts in each of the Internet accounts you wish to have the Software manage. The "Invite" feature is enabled by default in the Services every time you set up a new Linked Account, but disabled by deselecting it during the process. We may also collect Website usage statistics such as Internet addresses, browser types, domain names and page requests. This information is logged to help diagnose technical problems, prepare for network load demands, and to administer our Website in order to constantly improve the quality of the Services. 2.Cookies Standing alone, cookies do not identify you personally. They merely recognize your browser. Cookies come in two flavors: session and persistent-based. Session cookies exist only during an online session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you've closed your browser or turned off your computer. They include such information as a unique identifier for your browser. Our Services uses session cookies containing encrypted or encoded information including your username and session ID. This information allows us to process your requests. Session cookies help us make sure you are who you say you are after you've logged in and are required in order to use the Services. Our Services also use persistent cookies, that only our Services can read and use, to identify the fact that you are a user or prior Website visitor (whatever the case may be). We are especially careful about the security and confidentiality of the information stored in persistent cookies. For example, we do not store account numbers or passwords in persistent cookies. Web beacons (also known as clear gif technology, invisible GIFs, web bugs, or action tags) or web usage tracking scripts may be used to assist in delivering the cookies on the Services. This technology tells us how many visitors clicked on key elements (such as links or graphics) on a page. We do not use this technology to access your personally identifiable information; it is a tool we use to compile aggregated statistics about the Services usage. We may share aggregated Software and Website statistics with partner companies but do not allow other companies to place clear gifs on the Website. Users who disable their Web browsers' ability to accept cookies will be able to browse the Website but may not be able to successfully use the Services. 3.Third-Party Sites 4.Sharing of information The Software will send you status messages and other messages that to keep you updated on the status of your interactions with the Services. Examples include informing you of technical service or security issues related to the Services you requested, or confirming you requested a product or service. You cannot choose to unsubscribe to these messages, as they are considered an essential part of the Services.
