PRIVACY POLICY

Esaya, Inc. ("Esaya") has created this privacy policy ("Privacy Policy") in order to demonstrate our commitment to customer privacy.  Privacy on the World Wide Web site located at http://www.gathera.com and other computer systems operated by Esaya (collectively, the “Website”), is of great importance to us.  Because we gather important information from our users, we have established this Privacy Policy as a means to communicate our information gathering and dissemination practices.  We reserve the right to change this Privacy Policy and will provide notification of the change at least thirty (30) days prior to the change taking effect.

Please be aware that the Gathera Internet account aggregation program (“Software”) and Website (collectively “Services”) are not intended for use by persons under the age of 13.  Please see the section Children’s Privacy Policy for more details.

If you have objections to the Privacy Policy, you should not access or use the Services offered by Esaya.

Any capitalized terms used and not defined in the Privacy Policy are defined in the Terms of Service.

          1.Collected Information and how we use it
We require users who wish to use the Software offered on our Website to provide their User ID and / or email address and passwords for each Internet account that they wish the Software to manage. This information is required to authenticate your access to each of your accounts as well as to retrieve the information you request from those accounts.

If payment is required for the Software, Esaya will request your name, mailing address, phone number, credit card information and other information to securely process the financial transaction.  Esaya does not share, rent or lease this information with any third party nor will it use this information for any marketing or promotional use.  Esaya uses a third-party intermediary to manage the credit card processing.  This intermediary is solely a link in the distribution chain, and is not permitted to store, retain, or use the information provided, except for the sole purpose of credit card processing.

Using the Software requires the Esaya servers to host your personal data and information ("Data"). Such Data may include your username and password to your Linked Accounts and your email addresses.  Esaya does not scan the messages or information for specific words or phrases and will not read, share, distribute, print, reference or disclose to third parties private email communications or other messages or Data that are transmitted using the Services excepting as required for the purpose of resolving a problem, support issue, or suspected violation of the Terms of Service, or as may be required by law.

As part of the Services, you have the option to send a standard message inviting your contacts to join you in using the Services.  It will be sent to your contacts in each of the Internet accounts you wish to have the Software manage.  The "Invite" feature is enabled by default in the Services every time you set up a new Linked Account, but disabled by deselecting it during the process.

We may also collect Website usage statistics such as Internet addresses, browser types, domain names and page requests.  This information is logged to help diagnose technical problems, prepare for network load demands, and to administer our Website in order to constantly improve the quality of the Services.

          2.Cookies
When you interact with the Services we strive to make that experience easy and meaningful.  When you user our Services, our server sends a cookie to your computer.  Cookies are small text files that Web browsers place on a computer's hard drive and are used to tell us whether users and visitors have visited the Website previously.

Standing alone, cookies do not identify you personally.  They merely recognize your browser.  Cookies come in two flavors: session and persistent-based.  Session cookies exist only during an online session.  They disappear from your computer when you close your browser software or turn off your computer.  Persistent cookies remain on your computer after you've closed your browser or turned off your computer.  They include such information as a unique identifier for your browser.

Our Services uses session cookies containing encrypted or encoded information including your username and session ID.  This information allows us to process your requests.  Session cookies help us make sure you are who you say you are after you've logged in and are required in order to use the Services.  Our Services also use persistent cookies, that only our Services can read and use, to identify the fact that you are a user or prior Website visitor (whatever the case may be).  We are especially careful about the security and confidentiality of the information stored in persistent cookies.  For example, we do not store account numbers or passwords in persistent cookies.

Web beacons (also known as clear gif technology, invisible GIFs, web bugs, or action tags) or web usage tracking scripts may be used to assist in delivering the cookies on the Services.  This technology tells us how many visitors clicked on key elements (such as links or graphics) on a page.  We do not use this technology to access your personally identifiable information; it is a tool we use to compile aggregated statistics about the Services usage.  We may share aggregated Software and Website statistics with partner companies but do not allow other companies to place clear gifs on the Website.

Users who disable their Web browsers' ability to accept cookies will be able to browse the Website but may not be able to successfully use the Services.

          3.Third-Party Sites
The Services contains links to other web sites.  Should you click on an advertisement in an email message or on the Services, the advertiser, or a company on its behalf, may collect information or set and access cookies on your machine.  Esaya is not responsible for the privacy practices or the content of these other websites.  Users and visitors will need to check the policy statement of these others web sites to understand their policies.  Users and visitors who access a linked site may be disclosing their private information.  It is the responsibility of the user to keep such information private and confidential.

          4.Sharing of information
We will use your personally identifiable information only to provide the Services as described in the “Collected Information and how we use it” section above, to notify you of related technical or billing information.  We do not use the information collected to further contact you or your contacts to engage in interest in our company or the services that we provide.  If you would like further information on our company or products, please visit our corporate website at http://www.esaya.com.

The Software will send you status messages and other messages that to keep you updated on the status of your interactions with the Services.  Examples include informing you of technical service or security issues related to the Services you requested, or confirming you requested a product or service.  You cannot choose to unsubscribe to these messages, as they are considered an essential part of the Services.

Esaya will not disclose any of your personally identifiable information to anyone or any other company, excepting under the circumstances described below, excepting as required by subpoena, search warrant, or other legal process.

          5.Opt-Out Policy
Esaya offers its users a means to choose how we may use information provided.  If, at any time after signing-up for Services, you change your mind about receiving information from us, send us a request by emailing opt-out@gathera.com

          6.Security
The Website has security measures in place to help protect against the loss, misuse, and alteration of the Data under our control.  When transacting with your Linked Accounts, the Services will use the maximum level of security enabled by the provider of your Linked Account.  For example, if Facebook allows SSL to secure data transfer, Esaya will use it. Esaya also implements security methods based on dynamic data and encoded session identifications, and hosts the Website in a secure server environment that uses a firewall and other advanced technology to prevent interference or access from outside intruders.  These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of Data.

          7.Children’s Privacy Policy
Esaya respects the privacy of your child and we want to share with you our policies regarding children under the age of thirteen.  We have developed the Software and Website to appeal to adult visitors (visitors who are eighteen and older).  Visitors of all ages may navigate through the Website, download the Software and use the Services.  However, all online contact information collected from a user of the Services, including users who are under the age of thirteen, is used only to fulfill the requirements of the Services and is not maintained in retrievable form by Esaya after the provision of the requested Services.
